TERMS AND CONDITIONS AGREEMENT
All other prints and products not included in package you have chosen upon booking can be ordered via email. Print and album prices expire 3 months from the session date and prices are subject to change without CLIENT notice.
Entire Agreement: This agreement contains the entire understanding between Jordan Wicks Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. In the event that the parties waive a portion of this agreement, the contract is not waived in its entirety. The party against whom a waiver is sought to be effective must have the waiver in writing.
Reservation: A completed booking form via the website. A Session Fee retainer amount of $20.00 per horse and rider combination is due at time of booking to reserve your spot to be photographed at the horse event. The Session Fee of $10 per horse and rider combination is non-refundable.
Booked: You are not fully booked in to be photographed at an event until I have received the Terms and Agreement signed by the CLIENT and the Session Fee of $10 per horse and rider combination has been paid.
PAYMENT OF SESSION FEE AND SIGNED TERMS AND CONDITIONS AGREEMENT MUST BE RECEIVED by Jordan Wicks Photography no later than 6pm the day prior to the event commencing. If you fail to do so, you will not be photographed at the event.
If you are having problems signing the TERMS AND CONDITIONS AGREEMENT please contact Jordan immediately.
Model Release (Human and Animals/Pet): THE CLIENT grants Jordan Wicks Photography the unrestricted and irrevocable right to use and publish photos taken of THE CLIENT along with my name and/or my likeness, in any and all forms, including, but not limited to social media, print, marketing materials, photography competitions, commercial art, advertising, publishing (including publishing electronically online) and for any product or services and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Jordan Wicks Photography and its legal representatives and assigns from all claims and liability relation to said photographs.
THE CLIENT releases Jordan Wicks Photography from any and all claims that may arise out of the use or connection with the use of these images, including the expectation of privacy or confidentiality for myself and/or any minor child or children and/or pet/s depicted in these images. THE CLIENT acknowledges that they will not receive financial compensation or royalties of any kind associated with the images taken of THE CLIENT and/or the child/children and/or pets associated with these photographs.
Other lawful uses may be determined by Jordan Wicks Photography at a later time. THE CLIENT waives any and all rights to review or approve any uses of the images in marketing materials and publications of any type. THE CLIENT hereby releases Jordan Wicks Photography, its employees and any third-parties involved in the distribution or publication of these images, from any and all liability associated with my participation in the creation of these images.
Event organiser/holder: Jordan Wicks Photography's main focus is on the riders booked. However, if I am the only photographer attending the event, in return for the event organiser/holder allowing me to photograph only certain people (and not the whole event) I may capture images of their Champions etc a events so the club has images to use to promote events later on and provide the images as a thank you to the sponsors of the events.
Limit of Liability: Jordan Wicks Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Jordan Wicks Photography’s control, Jordan Wicks Photography liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
The client is liable for their pet. If the pet injures the photographer or another person the client is liable, Jordan Wicks Photography is not held liable or responsible.
In the event that the horse event is running behind schedule, Jordan Wicks Photography will do her utmost best to capture everyone that has booked to be photographed. Jordan Wicks Photography is not liable for the running of the horse event.
Extensive Editing Policy: It is standard that your photos be edited, and provided to you within 6 months. In the event that the CLIENT requests more extensive editing: Editing can be provided for a fee, to be paid prior to any additional editing being completed.
Weather Policy: In the event of weather conditions out of our control:
Due to photography equipment and lighting conditions, it is the photographer’s discretion if weather conditions are such that the session must be cancelled. If such an event occurs, you will be given the opportunity to reschedule for the next available competition that Jordan Wicks Photography is attending. If CLIENT pursues the session, regardless of the photographer’s advice, and the images are not up to Jordan Wicks Photography’s standards, the CLIENT will be responsible for all charges related.
Cancellation and Rescheduling Policy: If you must cancel, Jordan Wicks Photography must be notified a minimum 24 hours to the horse event commencing.
If the horse event is cancelled by the Club hosting the event. The CLIENT will receive their Session Fee refunded.
Terms and Conditions: Jordan Wicks Photography owns the copyright to all images and are protected by Australian and International copyright laws.
By viewing the gallery you understand and agree the images are PROOFS ONLY.
DO NOT download, copy, print-screen, take a screenshot with any device of the proof images, displayed watermarked images or text on this website. Proof images are for display purposes only.
Proof Images MAY NOT BE DISPLAYED OR USED on sites such as Facebook, social media, websites, forums, any documents or for advertising in any format without my written permission. People in breach of my Copyright Terms will result in you paying for each photograph stolen at double the rate, you will no longer be photographed at any horse events and you may face Legal Action.
Images purchased do not have the wording proof across the photographs. No editing (colour changing, etc) or cropping to images allowed on images purchased.
Images may not be reproduced, copied, manipulated or transmitted or to be used in conjunction with other Graphic Designers, Photographers or Artists without the written permission of Jordan Wicks Photography.
If you are found to have used PROOF ONLY images, you will be invoiced a stolen PROOF ONLY image fee per image. This fee starts at $200 per image. You and/or horse will also be no longer photographed at any events.
Terms and Conditions on Purchased Digital Images: All digital images purchased do not have the wording "proof/stolen" across the images.
All digital images purchased are for PERSONAL USE ONLY. NOT COMMERCIAL USE.
If you would like digital images for COMMERCIAL USE there is an additional fee on the High Resolution Digital Collection per image. COMMERCIAL USE is only available to purchased when purchasing images from the High Resolution Digital Collection.
All digital images purchased from the "Social Media Digital Collection" are images sized for social media only with small logo (this size is not suitable for printing).
All digital images purchase from the "High Resolution Digital Collection" do not have my logo on the images and you are able to get them printed.
Jordan Wicks Photography will not be responsible for losses of digital images or printing inaccuracies. You must save your digital images on your computer or disc/usb stick or external hard drive. I strongly suggests that you have you download and save your digital images to a computer and not just your mobile phone or tablet device. If purchasing images from the High Resolutions Digital Collection, please note that Mobile phones and tablets can resize the images smaller therefore losing the quality of the image.
Jordan Wicks Photography recommends that you print your images through a photography print store (eg. Garricks Camera House). This will ensure printing accuracy of colour, etc.
PERSONAL USE digital images can be used on your personal social media accounts (eg. Facebook) only.
PERSONAL USE digital images CANNOT be used commercially or used by a third party (newspaper, magazine, website, sponsor, etc.) without a commercial fee paid to Jordan Wicks Photography and the written permission of Jordan Wicks Photography. Commercial is a business, product or brand on either a website or third party websites (Facebook, Instagram, etc) or publications.
Delivery for digital images can be downloaded as soon as payment is made. A digital image includes colour correction, image straightening and words "proof" removed.
Digital images can be used for sale ads on their own. If you are wanting to provide the images to a Graphic Designer to create a sale ad you MUST contact Jordan Wicks Photography for written permission.
No editing (colour changing, etc) or cropping to images allowed on ALL digital images purchased.
Images may not be reproduced, copied, manipulated or transmitted or to be used in conjunction with other Graphic Designers, Photographers or Artists without the written permission of Jordan Wicks Photography.
If you are unsure if you are able to use the image you have purchased for something, please do not hesitate to email Jordan Wicks Photography and ask.
